The following Privacy Policy applies to visitors and users (the “User(s)”) who access https://www.k-shoa.org (the “Website“), which is owned and operated by the Foundation for the Benefit of Holocaust Victims (“FBHV“).

FBHV is committed to protecting the privacy and confidentiality of the Information (as defined below) collected from Users.

Please read this Privacy Policy carefully. By accessing the Website, you acknowledge and agree to the terms of this Privacy Policy without modification.

  1. GENERAL 
    1. This Privacy Policy becomes effective and binding upon your visit to or use of the Website. By accessing or using the Website, you expressly consent to the collection, storage, use, and transfer of your information (as defined below) in accordance with this Privacy Policy.
  1. The Website may contain inadvertent inaccuracies or typographical errors, which FBHV may correct at its discretion. While FBHV strives to ensure that the information on the Website is accurate and regularly updated, errors or omissions may occur, and certain information may become outdated between updates. FBHV disclaims any obligation or responsibility for the accuracy, completeness, or reliability of the content on the Website.
    1. FBHV takes reasonable measures to prevent viruses and other malicious software from affecting the Website. However, FBHV cannot guarantee that the Website will be free from security threats, and it accepts no liability for any viruses or other harmful components. Users are responsible for implementing appropriate safeguards, including the use of antivirus software, before downloading or accessing any content from the Website.
    1. FBHV is the data controller of the personal information collected through the Website. The information may be stored in a registered database owned and managed by FBHV, for purposes that include managing donations, handling aid applications, coordinating volunteers, processing job applications, and maintaining communication with donors and beneficiaries, all as set forth in this Privacy Policy.
  • THE INFORMATION FBHV COLLECTS AND HOW FBHV COLLECTS IT
    • We collect different types of information depending on your interactions with the Website, including, without limitations (the “Information”):
      • Information about Volunteers. If you choose to register for one of our volunteer opportunities, we may collect your personal details, including, without limitations: contact information (full name, phone/mobile number, email address, gender, residential address), ID number, date of birth, details about your vehicle, languages spoken, profession, etc. 
      • Information on Donations. If you choose to make a donation, you will be redirected to a third-party payment processor (such as IsraelGives). We do not collect or store financial information, except for the type of payment method used and the last four digits of your payment card.
      • Aid Applications. If you apply for aid through our online request form, we may collect different types of information depending on the nature of your request. This may include: contact details, details about your family members, income-related information, medical information, bank account details, etc. 
      • Job Applications. If you apply for a position through our Website, we will collect your contact details andresume.
      • Newsletter Subscription. If you subscribe to our newsletter, we will collect your email address (the “Newsletter”). 
      • Browsing Activities. When you visit or interact with our Website, we may automatically collect certain information about your browsing activities. This may include device information (such as type, operating system, and browser version), IP address, pages visited, time spent on pages, navigation paths, referring and exit pages, cookies and tracking data, as well as system activity logs.
      • Communications. When you communicate with us through the Website, email, phone, or other channels, we may collect and store information you provide, including your name, contact details, the content of your messages, and any additional information you choose to share.
    • How Do we Collect Your Information. 
      • We collect information that you voluntarily provide to us when you interact with the Website or communicate with us. This includes information submitted through registration forms, assistance requests, job applications, volunteer sign-ups, newsletter subscriptions, donations, and any direct correspondence with us via email, phone, or other communication channels.
      • In addition to the Website, FBHV maintains official pages on social media platforms, including Instagram, YouTube, and Facebook. This Privacy Policy also applies to information that FBHV collects or receives through these platforms — for example, when Users follow FBHV, share content, comment on posts, or send private messages. However, the use of information by those platforms is also subject to their respective privacy policies (such as those of Facebook, YouTube, or Instagram), and Users are encouraged to review those policies to understand how their information is processed by each platform.
      • Cookies and Tracking Technologies. FBHV uses technological tools to collect usage data on the Website, including the use of cookies (small text files stored on the User’s browser) and similar technologies, for statistical and operational purposes. These technologies — including web beacons and pixels — help FBHV monitor how the Website is used, assess the popularity of content and services, and improve User experience. The information collected is statistical and does not personally identify the User.

  • WHAT WE DO WITH THE INFORMATION
    • The Information will be used in accordance with applicable laws for the following purposes:
      • To process applications submitted through the Website for various purposes, including but not limited to making donations, requesting aid, registering for volunteer opportunities, and applying for employment. This processing is necessary to evaluate, manage, and respond to such applications effectively.
      • Improve the functionality, design and quality of the Website and activities performed through the Website.
      • To respond to inquiries, provide support, process requests, and improve our services. We may also retain records of our communications for internal training, quality assurance, and legal compliance purposes.
      • If a User has agreed to receive Newsletter from FBHV, we may use their Information to inform them about new features, functionalities, and services , as well as to send periodic updates, articles and newsletters.
      • Users may opt out of receiving Newsletter from FBHV by following the unsubscribe instructions included in each email or by contacting FBHV as specified in Section 4 below. However, please note that regardless of a User’s preference, FBHV may continue to send essential notices, including updates regarding changes to this Privacy Policy.
      • To gather analysis or valuable information enabling FBHV to monitor the usage of the Website.
      • To promote the safety and security of user data and our systems. This includes verifying the authenticity of Users accessing the Website, detecting and preventing fraudulent transactions, unauthorized access, and other illegal activities. Additionally, we utilize this information to address cybersecurity needs, enhance fraud detection measures, and prevent misuse of the Website.
      • To link or combine the Information with other information it receives from third parties to help understand user needs and provide better service.
      • Internal record keeping.
      • FBHV may publish Users’ testimonials on the Website, which may include personally identifiable Information. By providing a testimonial to FBHV, the User expressly agrees and consents to FBHV displaying the User’s name alongside the testimonial. If a User wishes to update or remove their testimonial, they may contact FBHV as specified in Section 4 below.
      • FBHV may use or disclose User Information when required to do so by law or where it has a legal right or duty to do so. This may include complying with legal processes, enforcing our rights, or disclosing Information in connection with investigations, legal disputes, or regulatory obligations, or managing insurance claims.
    • Anonymized Information. FBHV may process and use User Information in a de-identified or aggregated form by actively removing identifiers to ensure that it no longer identifies any individual (“Anonymized Information”). This may include data derived from information Users provide or from their interactions with the Website. Once anonymized, this information may be used for analytical, research, statistical, operational and other legitimate purposes, including improving the Website and services. FBHV may also share such anonymized or aggregated data with third parties without restriction, as it no longer constitutes personally identifiable information under this Privacy Policy.
    • Sharing your Information with Third Parties. FBHV may share the Information collected about Users with third parties for the limited purpose of providing them with access to the Website and features offered through the Website or as otherwise described in this Privacy Policy, as follows:
      • FBHV may use or disclose User Information when it has a legal right or duty to do so, such as in response to an investigation by a public authority, legal dispute, or other legal obligations.
      • FBHV may share User Information with third parties that provide and/or operate certain features embedded in the Website. Access to User Information is restricted to employees, consultants, or service providers who need to process the data to provide services to Users. FBHV ensures that such individuals are bound by confidentiality and nondisclosure obligations.
      • FBHV may share User Information with its legal counsel, accountants, potential partners/donors.
      • If FBHV restructures its operations within a different entity, merges with another organization, or integrates the Website with a third party, it may transfer User Information to the new entity. However, such entities must agree to be bound by the terms of this Privacy Policy. If they do not, FBHV will provide Users with a 30-day prior notice within the Website and the opportunity to delete their account information before the policy change takes effect.
    • FBHV collects and uses User’s Information only for legitimate and defined purposes, and in a manner that is reasonable, proportionate, and transparent. Depending on the nature of the interaction with the Website, the processing of Information may rely on one or more of the following grounds: User’s consent (for example, when User subscribe to the newsletter or provide information voluntarily); the need to perform a commitment or provide a requested service (such as handling donations, aid or volunteer applications); compliance with legal or regulatory obligations; or FBHV’s legitimate activities aimed at supporting its operations, maintaining relationships with donors and volunteers, ensuring information security, and improving its services, provided such activities do not unreasonably infringe on individuals’ rights to privacy.
  • HOW TO OPT-OUT?
    • Users who no longer wish to receive Newsletters from FBHV may opt out at any time by sending a request to info@k-shoa.org
    • Please note that even if you opt out of receiving Newsletters, FBHV may continue to send essential communications related to your activities, donations, or other interactions with FBHV, including via postal mail.
    • Users who wish to have their testimonials removed from the Website may submit a request by sending an email to info@k-shoa.org
    •   FBHV will process such requests within a reasonable timeframe.
  • INTERNATIONAL DATA TRANSFERS
    • FBHV may transfer and store User Information outside of the country in which it was originally collected, including to jurisdictions that may not provide the same level of data protection as your home country. This includes transfers to FBHV’s affiliates, partners, donors, and third-party service providers located in the United States, Europe, and other jurisdictions.
    • FBHV takes reasonable measures to ensure that international transfers of personal information are carried out in accordance with applicable data protection laws. Where information is transferred to countries that may not provide the same level of data protection as in Israel, FBHV seeks to use appropriate safeguards—such as contractual undertakings or equivalent protections—to help maintain the security and confidentiality of the information. 
    • By using the Website and agreeing to this Privacy Policy, you expressly consent to the transfer of your Information to countries outside of your jurisdiction, including to those that may not provide the same level of data protection as your home country.   • USER RIGHTS TO ACCESS AND CORRECT INFORMATION
    • As a general rule, Users are entitled to review the personal information collected and stored about them in FBHV’s databases and to receive a copy of such information, in accordance with applicable law. 
    • Requests to review or obtain a copy of personal information may be submitted by email to info@k-shoa.org.
    • If any personal information about a User is found to be incorrect, incomplete, unclear, or outdated, the User may request that it be corrected or updated.
    • Where a User has subscribed to our Newsletter, their information is stored in FBHV’s database for the purpose of direct mailing, and the User may request to be removed from that database at any time.
    • FBHV will review and process each request in accordance with applicable law. FBHV may require verification of the User’s identity or proof of authorization before processing such a request. A response will be provided as soon as reasonably possible and no later than thirty (30) days from the date of receipt. In exceptional cases that require a more complex review, FBHV may extend the response period by an additional thirty (30) days, subject to providing notice to the User. If FBHV decides not to comply with a request, in whole or in part, it will provide a written explanation setting out the legal grounds for the refusal.
  • SPECIFIC PROVISIONS FOR USERS FROM ISRAEL, UNDER THE ISRAELI PROTECTION OF PRIVACY ACT, 5741-1981. 
    • If you are an Israeli resident, please note that we collect, use, disclose, and otherwise process information as described in this Privacy Policy, with your consent where required by applicable law.
    • Users are under no legal obligation to provide FBHV with any information. However, if you choose not to provide the requested data categories, some or all of the features and functionalities of the Website may not be available to you.
    • If a User provides FBHV with personal details of another individual, the User must first provide that individual with a copy of this Privacy Policy and obtain their consent before disclosing their information to us.
    • According to the Israeli Privacy Protection Law, 1981 (the “PPA”), every individual has the right to review information about themselves, either personally, through a duly authorized legal representative, or via a legal guardian. If you submit a request to access and/or review the Information we hold about you (which may include a digital copy), FBHV will not charge a fee for processing such a request.
    • If, upon reviewing your Information, you find it to be incorrect, incomplete, unclear, or outdated, you may request that we correct or update the information accordingly.
    • If FBHV declines your request in accordance with the PPA, we will notify you of the decision and the reasons for it, following the procedures prescribed by the PPA and applicable regulations.
    • FBHV may require Users to provide certain credentials or verification documents to confirm their identity before processing any requests related to reviewing or modifying their Information.
  • INFORMATION RETENTION 
    • FBHV will retain Users’ Information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy. FBHV may also retain and use the Information as required to comply with legal obligations (such as data retention laws), resolve disputes, and enforce FBHV’s legal agreements and policies.
    • FBHV retains Users’ Information only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. As a general rule: (a) Volunteer and donor records are retained for up to seven (7) years after the end of the relationship or activity; (b) Job applications and résumés are kept for up to three (3) years following submission; (c) Aid applications and related materials may be stored for up to ten (10) years to comply with applicable reporting and auditing requirements.
  • Once the retention period expires, the data will be deleted or anonymized in a secure manner, unless continued retention is necessary for legal claims or compliance purposes.
    • The servers hosting the Website are located in the State of Israel. However, some User Information may be transferred outside of Israel to FBHV’s affiliates, partners, and donors in the United States, Europe, and other jurisdictions. User Information is stored on third-party-managed servers and has been configured to be stored in Israel and Europe. FBHV ensures that any cross-border data transfers comply with applicable data protection laws and that appropriate safeguards are in place to protect User Information. 
  • THIRD PARTY LINKS & WEBSITES

FBHV may provide links to third-party websites for specific services, such as donations or other activities. These third-party websites operate independently and may use tracking technologies, such as cookies, to collect information about your browsing activities. FBHV does not control these third-party websites or their data collection practices, and we encourage you to review their respective privacy policies before interacting with them.

  1. INFORMATION SECURITY
    1. FBHV uses industry standard security measures to protect the Information against unauthorized access to or unauthorized alteration, disclosure or destruction. These measures include internal reviews of the Information collection, storage and processing practices and security measures. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, FBHV cannot guarantee the absolute security of the Information.
    1. FBHV restricts access to the Information to FBHV’s employees, contractors and agents who need to know such Information. These individuals are bound by confidentiality obligations and FBHV requires all of them to agree to use the Information solely for the purpose for which it was initially provided to them, and strictly in accordance with this Privacy Policy.
  2. CHILDREN’S PRIVACY
    1. Users must be at least eighteen (18) years old to access FBHV’s Website. Individuals under 18 may only use the Website with the consent of a parent or legal guardian.
    1. FBHV does not knowingly collect personally identifiable information from individuals under the age of eighteen (18). If a parent or legal guardian becomes aware that an individual under the age of eighteen (18) has provided FBHV with any Information, they should contact FBHV immediately. If FBHV discovers that it has collected Information from an individual under the age of eighteen (18) without verified parental consent, it will take appropriate steps to delete such information from its servers.
  3. CHANGES TO THIS PRIVACY POLICY

FBHV reserves the right to update or modify this Privacy Policy at any time, with or without prior notice. Any changes will become effective upon posting the updated Privacy Policy on the Website. If material changes are made to this Privacy Policy, FBHV will provide prominent notice on the Website or via email, where feasible, prior to the changes taking effect. Your continued use of the Website after any modifications constitutes your acceptance of the revised Privacy Policy. We encourage you to periodically review this Privacy Policy to stay informed about our data practices. If we make material changes, we may provide additional notice as required by applicable law.

  1. MISCELLANEOUS 
    1. For any question, concern, comments or suggestions regarding this Privacy Policy, please contact FBHV at info@k-shoa.org  FBHV reserves the right at any time to modify this Privacy Policy. Any such modification will be effective immediately upon posting the amended Privacy Policy on the Website and/or by sending a notification to the Users. The User’s continued use of the Website after the effective date of any such modification will be deemed acceptance of such modified Privacy Policy.
    1. All disputes arising out of this Privacy Policy will be subject to the governing laws of the State of Israel, and the exclusive jurisdiction of the competent courts located in the city of Tel Aviv – Jaffa, Israel. The parties agree and submit to the personal and exclusive jurisdiction and venue of these courts, except that nothing will prohibit either party from instituting an action in any court of competent jurisdiction to obtain injunctive relief or protect or enforce its intellectual property rights. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Terms.

The copyrights in this publication, and any other information or content (including, without limitations, photos, videos, surveys, articles, etc.) provided through the Website are owned by FBHV, and they may not be copied, downloaded, reproduced, used, modified or distributed in any way (except as an integral part of an authorized copy of material appearing in these web pages), without the prior written consent of FBHV.
